TERMS OF SERVICE FOR PASAPET USERS
These Terms govern use of the Pasapet application by end users. Pasapet is a technology application for managing, organizing, and facilitating digital features related to pets. Pasapet does not provide medical, veterinary, or professional services on its own behalf.
1. Definitions
For purposes of these Terms:
- “Pasapet” or “Application”: the digital platform available on mobile devices or other channels enabled by Pasapet.
- “User” or “user”: the natural person who accesses, registers for, or uses the Application.
- “Content”: all information, data, images, documents, files, messages, and other materials uploaded, shared, stored, or transmitted by the user through the Application.
- “Services”: the features offered by Pasapet through the Application, including, among others, pet registration, document storage, reminders, calendar, communication, and any other functions Pasapet enables.
- “Provider”: the entity responsible for developing, maintaining, and operating the Application.
- “Third parties”: providers, businesses, partners, professionals, gateways, integrations, or any person or entity other than Pasapet and the user.
2. Acceptance of the Terms
By downloading, registering for, accessing, or using Pasapet, the user agrees to be bound by these Terms of Service, as well as the Privacy Policy and any complementary policy Pasapet publishes within the Application or by other reasonable means.
If the user does not agree to these Terms, they must not use the Application.
Access to certain features, including chat or communication functions, may require additional express acceptance of notices, rules of use, Community Guidelines, or other specific conditions Pasapet displays in the Application before enabling those functions.
3. Age and legal capacity
The user represents and warrants that they have the age and legal capacity required to be bound under applicable law.
If a minor uses the Application, such use must be under the supervision and responsibility of their parent or legal guardian, who will assume all responsibility for that use to the extent permitted by law.
Pasapet may impose access or use restrictions for minors when necessary for legal, operational, or security reasons.
4. Nature of Pasapet
Pasapet is a digital management application and technology platform. Its main function is to provide technological tools for organization, storage, display, reminders, communication and, where applicable, connection with services or features offered by third parties.
Pasapet is not a physician, veterinarian, clinic, hospital, laboratory, pharmacy, insurer, emergency center, or direct provider of professional or health services.
Use of Pasapet does not replace assessment, diagnosis, treatment, follow-up, or judgment by a qualified professional.
When the Application allows viewing providers, requesting appointments, managing bookings, storing records, sharing information, or interacting with third parties, those features do not make Pasapet the direct provider of the corresponding professional service.
5. User account
To access certain features, the user may need to create an account and provide truthful, up-to-date, and complete information.
The user is responsible for maintaining the confidentiality of their credentials, for all activity under their account, and for promptly notifying any unauthorized use or security incident.
The user may not assign, sell, transfer, or make their credentials or access to the Application available to third parties.
6. Permitted use of the Application
The user may use Pasapet only for lawful, personal, or internal purposes, in accordance with these Terms and applicable law.
It is prohibited to use the Application for fraudulent, unlawful, abusive purposes or in a way that affects the security, stability, or normal operation of the platform.
It is also prohibited, among other things, to:
- attempt unauthorized access to accounts, systems, databases, or restricted features;
- introduce malicious software, malware, viruses, or harmful code;
- alter, interfere with, or compromise the security or operation of the Application;
- reverse engineer, decompile, or attempt to obtain source code, except as expressly permitted by law;
- use the platform in a way that harms Pasapet, other users, or third parties;
- use the Application for commercial espionage, improper collection of information, or purposes incompatible with these Terms.
7. Community standards and conduct
The user agrees to use Pasapet, including any interaction, messaging, posting, exchange, or communication features with third parties, in a respectful, lawful manner consistent with these Terms.
Without limiting other prohibitions in this document, the following is strictly prohibited:
- harassing, intimidating, threatening, stalking, or abusing other users, providers, partners, or third parties;
- publishing, sending, sharing, or transmitting offensive, discriminatory, defamatory, obscene, sexually explicit, violent, hateful, or animal-exploitation content;
- impersonating another person or misleading others about the identity, affiliation, or authorization of the sender of a message or shared content;
- using the Application for fraud, deception, scams, spam, unsolicited bulk messaging, or unlawful activity;
- sharing content that violates third-party rights, including privacy, image, or intellectual property rights;
- using the Application in a way that risks the security, integrity, availability, or normal use of the platform or other users.
Pasapet does not tolerate objectionable content or abusive conduct within the Application. Violation of these rules may result, at Pasapet’s discretion and to the extent permitted by applicable law, in removal of content, restriction of features, temporary suspension, or permanent account termination.
8. Use of chat and communication features
When Pasapet enables chat, messaging, or communication between users, providers, or third parties, the user acknowledges and agrees that such tools must be used only for legitimate purposes related to features permitted by the Application.
The user agrees not to use chat or communication features to:
- send offensive, abusive, threatening, or harassing messages;
- send sexual, obscene, or inappropriate content;
- spread fraud, deception, impersonation, or scam attempts;
- send spam, unauthorized advertising, or unsolicited repetitive messages;
- share malware, malicious links, or content that compromises others’ security;
- engage in any conduct contrary to these Terms, the Community Guidelines, or applicable law.
Pasapet may enable mechanisms for the user to:
- report messages, content, or conduct they consider inappropriate;
- block other users or limit unwanted interactions;
- report accounts or activities that may be abusive, fraudulent, or risky.
The user acknowledges and agrees that Pasapet may review reported content, investigate incidents, and take reasonable measures to protect platform and user security, including deleting messages or content, restricting chat access, temporarily suspending accounts, or permanently removing violating users.
Pasapet reserves the right to act on reports of objectionable content or abusive conduct within a reasonable timeframe according to its internal processes, security policies, and operational capacity.
9. Third-party services and user decisions
The user acknowledges that any decision regarding medical or veterinary care, treatments, diagnoses, medications, procedures, emergencies, providers, or professional services must be based on direct evaluation by a qualified professional and not solely on information shown in the Application.
If the Application displays profiles, data, schedules, reviews, categories, content, availability, or third-party information, Pasapet does not warrant that such information is accurate, complete, current, or suitable for each user’s particular needs.
Any contractual, professional, clinical, commercial, or service relationship between the user and a third party is understood to be between those parties, unless Pasapet expressly states otherwise for a specific feature.
10. Medical and professional disclaimer
Pasapet does not diagnose, prescribe, treat, cure, or provide medical, veterinary, or clinical services.
Information, reminders, documents, histories, records, profiles, content, or features available in the Application are for informational, organizational, administrative, or digital support purposes and do not constitute medical, veterinary, clinical, pharmaceutical, or professional advice.
In an emergency, the user must immediately seek a qualified professional or the appropriate emergency services.
If Pasapet uses automated tools, algorithms, or artificial intelligence technologies to organize information, generate recommendations, or improve features, such tools are for informational and support purposes only and will not replace the judgment of a licensed professional.
11. Collection and use of information
Pasapet may collect, generate, store, and process information provided by the user, information derived from use of the Application, and technical or interaction device information, as necessary to operate the app, provide support, improve features, develop new tools, personalize the experience, prevent fraud, conduct internal analysis, and comply with legal obligations.
Collection and processing of personal data will be carried out in accordance with Pasapet’s Privacy Policy and applicable data protection law.
In addition, the user acknowledges and agrees that Pasapet may share user and pet information with other businesses, providers, or partners that are part of the Pasapet ecosystem, to the extent necessary or useful to enable features, facilitate services, improve experience, coordinate interactions on the platform, offer related tools, or support operation and development of the ecosystem, always subject to the Privacy Policy and applicable law.
Pasapet may also use information provided by the user and information derived from use of the Application to develop, test, train, validate, operate, and improve automated tools, algorithms, models, or features based on artificial intelligence, machine learning, or similar technologies, in accordance with the Privacy Policy, applicable law, and reasonable security measures. Where appropriate, Pasapet may use aggregated, de-identified, or anonymized information for analysis, training, improvement, or validation of these tools and features.
The user represents that information they upload, share, or store in the app has the necessary legitimacy for its use and processing. When the user shares information about third parties, they are responsible for having any required authorizations.
12. Permissions, content, and accuracy of information
The user is responsible for the accuracy, integrity, lawfulness, and currency of information they enter, upload, retain, or share in the Application.
Pasapet may rely on device or account permissions for certain functions. If the user denies required permissions, some features may not work fully or partially.
Unless expressly stated otherwise, the user retains ownership of Content they upload to the Application, but grants Pasapet a limited, non-exclusive, revocable license as necessary to store, process, back up, display, and use such Content to operate the Application, provide the Services, comply with legal obligations, resolve security incidents, and improve the service.
13. Intellectual property
The Application, its software, design, interface, architecture, trademarks, logos, trade names, texts, compilations, graphics, databases not belonging to the user, features, and other Pasapet elements are owned by Pasapet or its licensors and are protected under applicable law.
These Terms do not transfer any intellectual property rights in the Application to the user, except for the limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use it in accordance with these Terms.
14. Security
Pasapet will implement reasonable technical and organizational measures to protect information and platform security, consistent with standards appropriate to the nature of the service.
However, no system is completely secure; therefore Pasapet does not guarantee absolute security or total absence of incidents.
The user is responsible for:
- keeping credentials confidential;
- using secure connections and reasonably updated devices;
- not sharing their account with third parties;
- promptly reporting any suspected unauthorized access, misuse, or security incident.
15. Availability, changes, suspension, and termination
Pasapet may modify, update, suspend, restrict, or discontinue Application features in whole or in part at any time, with or without prior notice, when reasonably necessary for technical, operational, security, regulatory, commercial, or maintenance reasons.
Pasapet may suspend, restrict, or cancel accounts, and remove content, messages, or interactions, when the user breaches these Terms, violates third-party rights, publishes or transmits objectionable content, engages in abusive conduct, or poses risks to the security, integrity, or operation of the platform or other users.
The user may stop using the Application at any time and request account cancellation through mechanisms enabled by Pasapet.
Termination or cancellation of the account will not affect provisions that by their nature should survive, including those relating to liability, indemnity, intellectual property, jurisdiction, and legal compliance.
16. Limitation of liability
To the maximum extent permitted by applicable law, Pasapet provides the Application and Services “as is” and “as available,” without express or implied warranties of any kind.
Pasapet does not warrant, among other things:
- uninterrupted availability of the Application;
- absence of errors, bugs, or technical issues;
- absolute security of data or systems;
- fitness of the Application for the user’s specific purposes;
- accuracy, completeness, or integrity of third-party information or content.
To the maximum extent permitted by applicable law, Pasapet will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of data, revenue, profits, reputation, opportunities, or business continuity arising from use or inability to use the Application.
Pasapet will also not be liable for acts, omissions, diagnoses, treatments, services, charges, breaches, negligence, errors, delays, clinical or professional results attributable to third parties.
Pasapet’s total cumulative liability to the user, for any reason, will be limited to the amount the user paid directly to Pasapet in the twelve (12) months preceding the event giving rise to the claim or, if no payments were made, to the nominal sum of USD $50 or its equivalent in local currency, to the extent permitted by law.
17. Indemnity
The user agrees to indemnify and hold harmless Pasapet, its affiliates, directors, representatives, employees, and providers against claims, damages, losses, costs, penalties, and expenses, including reasonable attorneys’ fees, arising from: (i) misuse of the app; (ii) information or Content they upload or share; (iii) breach of these Terms; or (iv) violation of third-party rights or applicable law.
18. Links, integrations, and external services
The Application may contain links, integrations, gateways, services, or third-party content. Such elements are provided for convenience and do not imply endorsement, control, or warranty by Pasapet, unless expressly stated otherwise.
Use of external services may be subject to the third party’s own terms and policies, which the user is responsible for reviewing.
19. Communications
The user authorizes Pasapet to send communications related to operation of the Application, including service notifications, security notices, legal communications, changes to the Terms, and other communications necessary for the service to function.
The user may manage, where applicable, preferences regarding promotional or marketing communications, without prejudice to certain operational or legal communications that are necessary and cannot be disabled.
20. Changes to the Terms
Pasapet may modify these Terms at any time. Updated versions may be published in the Application, on the website, or by other reasonable means.
Continued use of the Application after a new version takes effect will constitute acceptance of the updated Terms, unless applicable law requires an additional acceptance mechanism.
21. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Costa Rica, unless mandatory law provides otherwise.
Any dispute related to these Terms will be subject to the jurisdiction of the competent courts of Costa Rica, unless mandatory applicable law provides another solution.
22. Severability
If any provision of these Terms is held invalid, void, or unenforceable in whole or in part, that provision will be interpreted or adjusted to the minimum extent necessary to be valid and enforceable, without affecting the validity and enforceability of the remaining provisions.
23. Entire agreement
These Terms, together with the Privacy Policy and any complementary policy or document expressly incorporated by reference, constitute the entire agreement between Pasapet and the user regarding use of the Application and supersede any prior understanding or communication on the same subject, to the extent permitted by law.
24. Contact
For questions, notices, or claims related to these Terms, the user may contact Pasapet through the official channels indicated by the Application or website from time to time.
